To put it bluntly, this is a unilateral breach of contract by the consumer, and it is indeed unjustifiable for the merchant to bear all the losses. From the perspective of the gym, there are actually difficulties. Many opening discount cards are priced very low, and they rely on the "silent cost" of some people to apply for the card impulsively and not use it. If everyone refunds casually, the membership fees they collected in advance have long been used to pay rent and buy equipment. It is easy for problems in the capital chain. As long as the deduction is not too outrageous, such as deducting 70% to 80% of the fee at the first opening, in fact, most of them can accept it after negotiation.
There are also situations where refunds cannot be made. For example, the short-term experience cards of 9 yuan and 9 yuan and 19 yuan and 9 yuan are clearly marked on the page when you buy them. "Special welfare cards are non-refundable and non-exchangeable."; There are also those who have spent several years rummaging through their belongings and remembering that they have a fitness card that has not been activated. The statute of limitations has long passed, and even if they sue, it will be difficult to get support.
If you really encounter a card refund dispute, don't quarrel with the front desk. First, sort out the evidence, such as the chat history of the merchant's failure to honor the service, the original promotional materials, and your check-in record. First go to 12315 or the local market supervision office for mediation. It is much more effective than sitting at the front desk all afternoon. If you really encounter a rogue merchant, filing a small lawsuit is not as troublesome as you think. Most merchants are not willing to get involved in lawsuits, and they will contact you to negotiate a refund within a few days of receiving the summons.
