Can the gym fitness card be refunded?

I have coordinated seven or eight card refunds for friends and colleagues. Except for one case where the gym ran away directly and the assets were liquidated long ago without receiving the money, the rest were either fully refunded or some reasonable fees were deducted and were successfully credited. To put it bluntly, the "no return, no exchange" notice printed on the back of the contract, or even just posted on the wall of the front desk, is itself an invalid format clause clearly recognized in the Civil Code - why is it that the benefits are all taken by the merchant, and the consumer does not enjoy reciprocal service after paying for it, and does not even have the right to a refund?

Last month, the gym downstairs in my community said it was going to be renovated and upgraded. It has been closed for three months and has not yet opened. A dozen or so neighbors from the owner group who had annual passes organized a group to refund their cards. At first, the boss insisted, "You all live so close together and just wait. It's impossible to refund your cards." , as a result, someone called 12315. When the market supervision personnel came, they read the "open 24 hours a day, all year round" printed on the promotional page they originally sent. They relented and agreed to a full refund on the same day, and they did not even let everyone return the sports bag they had received when they applied for the card.

Of course, it is not always possible to ask for a full refund in every situation. I met a girl who just graduated before. After applying for a card for two years and going there for three months, she suddenly moved to a city in a neighboring province and wanted to cancel the card. The gym initially said that it would deduct 30% of the penalty fee. The girl did not agree and went to the Consumers Association. In the end, the corresponding fees for the three months that had been used were deducted, and a 10% handling fee was deducted. To put it bluntly, this is a unilateral breach of contract by the consumer, and it is indeed unjustifiable for the merchant to bear all the losses. From the perspective of the gym, there are actually difficulties. Many opening discount cards are priced very low, and they rely on the "silent cost" of some people to apply for the card impulsively and not use it. If everyone refunds casually, the membership fees they collected in advance have long been used to pay rent and buy equipment. It is easy for problems in the capital chain. As long as the deduction is not too outrageous, such as deducting 70% to 80% of the fee at the first opening, in fact, most of them can accept it after negotiation.

There are also situations where refunds cannot be made. For example, the short-term experience cards of 9 yuan and 9 yuan and 19 yuan and 9 yuan are clearly marked on the page when you buy them. "Special welfare cards are non-refundable and non-exchangeable."； There are also those who have spent several years rummaging through their belongings and remembering that they have a fitness card that has not been activated. The statute of limitations has long passed, and even if they sue, it will be difficult to get support.

If you really encounter a card refund dispute, don't quarrel with the front desk. First, sort out the evidence, such as the chat history of the merchant's failure to honor the service, the original promotional materials, and your check-in record. First go to 12315 or the local market supervision office for mediation. It is much more effective than sitting at the front desk all afternoon. If you really encounter a rogue merchant, filing a small lawsuit is not as troublesome as you think. Most merchants are not willing to get involved in lawsuits, and they will contact you to negotiate a refund within a few days of receiving the summons.
